Description

It is not an exaggeration to say that the basis of the law-ruling country is to be maintained by the very logical, systematic and appropriate pyramid of laws headed by the Constitution. The Diet is the only one law-making organization of Japan . Both bills of the Diet member's proposal and the bills of Cabinet's proposal, discussed there, will trace the following processes. The project plan of a bill is made on the basis of a certain legislation policy. A concrete plan is formed through the interests' adjustment with related organizations. Through this political process, Legal Philosophies are fixed and the bill is formed. The bill is submitted to the Diet and after the discussion it will be approved as a law.

In the class, we will deepen knowledge and understanding concerning such a series of legislation process and practices, as follows:

(1) Firstly we will study the outline of Legislation. Secondly I will explain the planning process both of the Cabinet proposal and the Diet member's proposal. Thirdly students shall have a training of drafting bills of new laws.

(2) Students should understand that extracting Legal Philosophies is the key for drafting bills and that accumulated legislation habitual practices comprised of a lot of legislation technique are important. Students shall have a training of drafting bills of amendments laws, whose legislation technique are quite unique.

(3) I will explain the legislation cases, such as the Product Liability Law and other laws that I myself have drafted before.

We will have a tour to look around the Cabinet Legislation Bureau near the end of the lecture.
