Description

Purpose of the lecture: Some basic concepts of public law (constitutional and administrative law) will be explained, which are necessary to criticize or improve existing legal institutions as well as to make new ones. Subjects will not be treated in a comprehensive manner but in a selective manner, giving priority to certain particular aspects. The lecture is intended for beginners of law, on the one hand, and students who, graduating from law departments, seek to obtain a deeper understanding of what public law is in the present day, on the other hand.

Content of lecture: In this semester, the following themes will be taken up from the viewpoint of constitutional law and administrative law.

・  Structure of constitutional state: concept of the constitution; relation between the interpretation of constitutional law and the comparative study of law; constitutionalism; supremacy of the constitutional law; organization of the government, etc.

・The private law and the government intervention: necessity and limit of the government intervention; various forms of government intervention; tendency toward deregulation, privatization, public-private partnership, etc.
